1. Agreement

Welcome to BuzzerPlayer.com (“BuzzerPlayer”, “Company” or “Site”). By using this Site, you agree to be bound by these Terms and Conditions. You also agree to comply with any guidelines or rules posted on the Site regarding any product offered. All such guidelines are incorporated into these Terms and Conditions. Please read them carefully.

 

2. Communications

When you visit the Site, purchase products, or email the Company, you are communicating with us electronically. You consent to receiving communications from us electronically via email or notices posted on the Site. All such communications satisfy any legal requirement that they be in writing.

Any comments, ideas, suggestions or other communications sent to the Company shall remain its exclusive property and may be used without compensation to you.

 

3. Orders and Pre-Orders

3.1 Customer Responsibility for Audio Content

  • Customers must ensure that uploaded audio files are clear, audible, and free from distortion or background noise.
  • BuzzerPlayer integrates files exactly as submitted and does not guarantee improvements to customer-supplied audio.
  • BuzzerPlayer is not liable for poor results caused by low-quality or incorrect audio, nor obliged to replace or refund products ordered with the wrong model, version, or configuration.
  • By uploading audio files, you confirm that you own or are licensed to use the content. You remain solely responsible for any intellectual property disputes.

3.2 Order Confirmation, Cancellation and Changes

  • Orders are processed immediately upon submission. Please verify all details before checkout.
  • Cancellations must be requested by email at contact@buzzerplayer.com as soon as possible and before production begins. The Company reserves the right to charge up to the full order value to cover processing and wastage.
  • Orders may be amended before production begins. Once dispatched, shipping and handling charges are non-refundable.

3.3 Optional Features & Shipping Information

  • Customers are responsible for correctly selecting or removing any add-ons before checkout.
  • Customers must provide a complete and accurate shipping address. Incorrect or incomplete addresses may result in additional re-shipping charges.

 

4. Payment Terms

  • Payment must be received before acceptance of an order.
  • Accepted payment methods include Visa, MasterCard, Google Pay, Apple Pay and PayPal (subject to change).
  • Orders are not binding until confirmed by the Company.

 

5. Delivery

  • Dispatch is normally within 1–2 working days after receipt of a completed order. Delivery times may vary depending on destination and customs clearance.
  • A product is considered lost only after 15 business days from dispatch.
  • The Company is not liable for any delays outside its control.

 

6. Customs Clearance (EU Orders)

  • Goods shipped from the UK to the EU are subject to customs clearance under DAP (Delivered At Place) terms.
  • Customers are responsible for import VAT, customs duties, and handling fees, payable upon delivery.
  • The customer is the importer of record and must comply with local customs regulations.
  • BuzzerPlayer provides export documentation but is not liable for customs delays or charges.

 

7. Returns, Refunds & Warranty

7.1 Right of Withdrawal

  • Under UK and EU law, customers may cancel an order for non-customised products within 14 days of receipt, provided items are unused and in original condition.
  • This right does not apply to customised products (e.g., buzzers with uploaded or requested audio), in accordance with Article 16(c) of EU Consumer Rights Directive 2011/83/EU.

7.2 Defective or Faulty Products

  • If a product is defective upon arrival, the customer need to send a video proof to the support team at contact@buzzerplayer.com before BuzzerPlayer offer a replacement or a refund (excluding delivery charges).
  • Customers must contact contact@buzzerplayer.com to report defects.
  • Products damaged through misuse, modification, or normal wear and tear are not eligible.

7.3 Limited Warranty

  • The warranty excludes malfunctions caused by misuse, neglect, alteration, improper storage, extreme temperatures, acts of nature, or unauthorized installation/repairs.
  • This limited warranty covers only refunds or replacements of BuzzerPlayer products.
  • All products are provided on an “as is” basis. Information on the Site is provided in good faith but without guarantee of accuracy.

7.4 Refund Processing

Refunds will be processed within 15 business days of confirmed approval by the support team.

 

8. Replacement Policy

  • Personalized audio products are subject to a £25 cancellation fee.
  • If audio provided by the customer is of poor quality, BuzzerPlayer will not rework or replace the product.
  • The Company may require the return of products before confirming eligibility for replacement.

 

9. Taxes

All prices include VAT unless otherwise stated.

 

10. Intellectual Property & User Content

10.1 Ownership & Licensing

Customers retain ownership of their audio files (“User Content”) but grant BuzzerPlayer a limited license to use them solely for fulfilling the order.

10.2 Prohibited Content

User Content must not:

  • Infringe intellectual property rights.
  • Violate privacy or data protection laws.
  • Be false, defamatory, obscene, offensive, discriminatory, violent, or illegal.

10.3 Responsibility

  • Customers are solely responsible for any claims arising from their User Content.
  • BuzzerPlayer is not liable for third-party disputes related to such content.

 

11. Sound Samples

Sound samples provided on the Site are for reference only and may differ from actual playback inside the buzzer.

 

12. Promotion Codes

  • Only one code/voucher may be redeemed per order.
  • Codes may not be combined with other promotions unless explicitly stated.

 

13. Governing Law & Jurisdiction

  • These Terms are governed by the laws of the United Kingdom.
    The parties agree that UK courts shall have jurisdiction.
  • In case of legal proceedings, the prevailing party is entitled to recover costs and reasonable attorneys’ fees.

 

14. Miscellaneous

  • Customers may not assign their rights or obligations under these Terms without prior written consent from BuzzerPlayer.
  • Links to third-party websites are provided for convenience only and do not imply endorsement.
  • These Terms replace any conflicting terms in customer-issued documents such as purchase orders or specifications.

15. Intellectual Property – Company Rights

15.1 Ownership

All trademarks, trade names, logos, product names, designs, graphics, photographs, text, software, source code, and other content displayed on or associated with the Site, including but not limited to the name “Buzzer Player”, the Buzzer Player™ brand, and all related logos and designs (the “Company IP”), are the exclusive property of BuzzerPlayer or its licensors. These rights are protected under UK and international copyright, trademark, and intellectual property laws.

15.2 Copyright Notice

The Buzzer Player logo(s), designs, and visual content are original works and are automatically protected by copyright law from the moment of their creation. Unless expressly authorised in writing by the Company, no part of the Site or Company IP may be copied, reproduced, distributed, modified, displayed, performed, published, licensed, or otherwise exploited for any commercial purpose.

15.3 Restrictions

You may not:

  • Use, imitate, or copy any Company IP in whole or in part without prior written consent from the Company.
  • Register or attempt to register any domain name, social media account, or business name that incorporates or is confusingly similar to the Company IP.
  • Remove, obscure, or alter any copyright, trademark, or other proprietary rights notices displayed on the Site or on products.

15.4 License to Users

Subject to compliance with these Terms, BuzzerPlayer grants users a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its content for personal, non-commercial purposes only. No rights are granted to copy, distribute, or create derivative works from Company IP except as explicitly permitted.

15.5 Enforcement

The Company takes infringement of its intellectual property seriously and reserves the right to take legal action, including but not limited to injunctions, damages claims, and recovery of legal costs, against any party that violates these rights.
